Civil Investigations Liability and Personal Injury Cases :-
These are the cases between parties involved in litigation with each other. Investigations are done either to recover claims or to absolve oneself from any liability of claim launched by other party. These could be in respect of ownership disputes over property, accident cases where insurance companies are facing tribunals for claims or contractual obligations and violations. Much is at stake for the warring parties and the investigator is required to provide litigation support either in favor or against. Such like disputes are subject matter of court's decision or out of court settlement by the parties. The investigator has to strengthen the hands and claims / counter claims of his client. As such, he must be acquainted with laws involved, rulings available and the procedure to be followed in collecting evidence from public records to establish overt and covert acts of opposite parties and then provide material to his client. Civil disputes involve a lot of financial implications and the specialist investigator must keep himself informed about accountancy.
Criminal Investigations
Most of the times, it is the Police or the state which launches prosecution for offences committed.As per law, the onus of proving a person guilty of a violation lies with the prosecution (barring a few exceptions). However, the private investigator has to provide evidence to create an ‘alibi' for absolving a client or to destroy authenticity of the prosecution's allegations by discrediting a witness through character assassination (past conduct inquires etc.) Sometimes the investigator has to do a policemen's job of unearthing evidence so that his client can convince the authorities for registration and investigation of an alleged offence.
